1. Agreement to these Terms
These Terms of Service (“Terms”) govern your access to and use of the website located at tttenley.film and any related pages, films, content, products, and services we offer through it (together, the “Site”). The Site is operated by Tenley E. Raj, doing business as Tenley Films (“Tenley Films,” “we,” “us,” or “our”).
By accessing or using the Site, watching films, subscribing to communications, placing an order, or otherwise interacting with the Site, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, please do not use the Site.
2. Who we are and how to reach us
tttenley.film is the official film portfolio of Tenley E. Raj, an independent writer, director, cinematographer, and editor based in Houston, Texas. The Site features her films, trailers, and related work. Questions about these Terms can be sent to me@tttenley.com.
3. Eligibility
Some films and content on the Site explore mature psychological themes and may not be suitable for all audiences. You must be at least 18 years old, or the age of majority where you live, to make a purchase. By using the Site you represent that you meet these requirements, or that you are using the Site under the supervision of a parent or legal guardian who agrees to these Terms. The Site is not directed to children under 13, and we do not knowingly collect information from them.
4. Use of the Site and viewing of films
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access the Site and to stream and view the films and content we make available, solely for your own personal, non-commercial enjoyment, and subject to these Terms and any additional terms presented with a specific film or product.
You agree not to:
- download, copy, record, capture, rip, screen-record, reproduce, distribute, publicly perform or display, broadcast, or create derivative works from any film or content, except where we expressly provide a download or where the law clearly permits it;
- remove, alter, or obscure any copyright, credit, watermark, or other proprietary notice;
- use the Site or any content for any commercial purpose, including public exhibition, without our prior written permission;
- use any robot, spider, crawler, scraper, or other automated means to access the Site or collect content or information from it, except for standard search-engine indexing;
- circumvent, disable, or interfere with any security, access-control, or rights-management features of the Site or any embedded video player;
- attempt to gain unauthorized access to the Site, its servers, or connected systems; or
- use the Site to violate any law, infringe any rights, transmit harmful code, or harass or harm any person.
We may suspend, restrict, or terminate your access at any time, with or without notice, for any reason, including any suspected violation of these Terms.
5. Intellectual property
The films, trailers, video, audio, scripts, images, photographs, artwork, graphics, text, designs, logos, the Tenley Films name and marks, and the selection and arrangement of all of the foregoing are the original works of Tenley E. Raj, who writes, directs, shoots, and edits her films, or are otherwise owned by or licensed to her, and are protected by copyright, trademark, and other intellectual property laws.
These films represent significant creative and personal investment. Nothing in these Terms transfers any ownership or license to you beyond the limited personal viewing license described above. You may not use, copy, distribute, exhibit, or exploit any film or content without our prior written permission. You may share links to publicly available pages of the Site through normal social sharing.
6. User submissions
If you submit any content to us, including messages through our contact form, comments, reviews, testimonials, or other materials (“Submissions”), you grant us a worldwide, perpetual, irrevocable, royalty-free, fully paid, transferable, sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, publicly display, and otherwise exploit those Submissions in any media now known or later developed, for any purpose, including marketing, advertising, and promotion of Tenley Films and her films.
You represent that you own or control all rights in your Submissions, that they are accurate, and that they do not violate these Terms or any third-party rights. We are not obligated to use, store, or return any Submission, and we may remove any Submission at our discretion.
7. Newsletter and communications
If you sign up for our newsletter or updates, you agree to receive news, film updates, announcements, promotions, and related communications from us. You can opt out of promotional emails at any time using the unsubscribe link in those emails or by contacting us at me@tttenley.com. How we handle the information you provide is described in our Privacy Policy.
8. Purchases, rentals, and digital content
From time to time, the Site may offer products for sale or rental, including film rentals or downloads, digital content, and merchandise. The following terms apply to any such transaction.
Product information and pricing. We try to describe and price products accurately, but we do not warrant that descriptions, pricing, availability, or other content are complete, current, or error-free. Prices are in U.S. dollars unless stated otherwise and exclude taxes and any shipping unless stated. Prices and availability may change without notice. We may correct errors at any time, including after an order is submitted.
Orders and acceptance. Your submission of an order is an offer to buy. We may accept or decline any order, in whole or in part, for any reason, including suspected fraud, pricing errors, or unavailability. No order is binding on us until we accept it.
Payment. Payments are processed by third-party payment processors. By submitting payment information, you authorize us and our processors to charge your chosen payment method for the full amount of your order, including taxes and any shipping. You represent that you are authorized to use the payment method provided. Payment data is handled by our processors under their own terms and privacy practices.
Digital content and rentals. For digital purchases and rentals, we grant you a limited, personal, non-commercial, non-transferable license to access the content for the period and on the terms described at the time of purchase. You may not copy, share, redistribute, or publicly exhibit digital content. Access may require a continued internet connection and a compatible device, and may depend on third-party platforms.
Physical merchandise. Risk of loss and title for physical products pass to you upon our delivery to the carrier. Shipping dates are estimates and not guaranteed. You are responsible for providing an accurate shipping address.
Returns and refunds. Unless otherwise stated at the time of purchase, digital content, rentals, custom, personalized, and final-sale items are non-refundable. Any return or refund conditions for physical items will be made available on the Site or at checkout. To request a return or report a problem, contact us at me@tttenley.com.
9. Third-party links and services
The Site relies on and links to third-party platforms and services, including video hosting and streaming providers, social media, email and marketing tools, and payment processors, that we do not own or control. We are not responsible for the content, products, policies, or practices of any third party. Your use of third-party services is governed by their terms and policies, not ours.
10. Disclaimers
The Site and all content, films, and products are provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the Site or any film will be available, uninterrupted, secure, or error-free, that any video will play on your device, or that defects will be corrected. You use the Site and view content at your own risk.
11. Limitation of liability
To the fullest extent permitted by law, in no event will Tenley E. Raj or Tenley Films, or any of our affiliates, contractors, or service providers, be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to your use of, or inability to use, the Site, any film, or any product, whether based in contract, tort, strict liability, or any other theory, even if we have been advised of the possibility of such damages.
To the fullest extent permitted by law, our total aggregate liability for all claims relating to the Site, any film, or any product will not exceed the greater of the amount you paid to us for the item giving rise to the claim, or fifty U.S. dollars ($50). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
12. Indemnification
You agree to indemnify, defend, and hold harmless Tenley E. Raj and Tenley Films, and our affiliates, contractors, and service providers, from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to your use of the Site, your Submissions, your purchases, or your violation of these Terms or any law or third-party right.
13. Privacy
Your use of the Site is also governed by our Privacy Policy, which describes how we collect, use, share, and otherwise handle information, including for marketing, advertising, and monetization purposes. Please review it carefully.
14. Changes to these Terms
We may update these Terms at any time. When we do, we will revise the “Last updated” date above. Changes are effective when posted. Your continued use of the Site after changes are posted means you accept the revised Terms.
15. Governing law and dispute resolution
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Site that is not resolved informally will be brought exclusively in the state or federal courts located in Harris County, Texas, and you consent to the personal jurisdiction of those courts.
Before filing any claim, you agree to first contact us at me@tttenley.com and attempt in good faith to resolve the dispute informally for at least thirty (30) days.
16. Miscellaneous
These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Site and supersede any prior agreements. If any provision is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them freely, including in connection with a sale or transfer of our business or assets.
